Introduction
Welcome to ModelPhotoAI. These Terms of Service ("Terms") govern your access to and use of the ModelPhotoAI website and services operated by ModelPhotoAI ("we", "us", "our").
By creating an account or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our services.
Who We Are and Where the Service Is Offered
ModelPhotoAI is a company based in Argentina. The service is offered only in Argentina. You can reach us at hello@modelphotoai.com.
The service is intended for users in Argentina. If you access it from another country, you do so on your own initiative and you are responsible for complying with the laws that apply where you are.
Paid Plans and Payment Processing
Paid plans are purchased by email. After you request a plan from the pricing page (you must be logged in), we reply with the payment instructions, and the plan's credits are added to your account once the payment is confirmed. The Free plan (100 credits on signup, no credit card) needs no payment.
Prices, included credits and billing periods are shown on our pricing page. By paying you also accept the terms of the payment provider indicated in our reply.
Service Description
ModelPhotoAI is an AI-powered platform that generates model photography and short videos for fashion and e-commerce products. Our services include:
• Model photo generation from your product and garment images (Dress Model)
• Social-media style photo generation (InstaShoot)
• Persona reference image creation (Model Creator)
• Image-to-video generation (Animate Photo) and motion transfer from a reference video (Motion Capture)
Generations are produced by third-party AI providers listed in our Privacy Policy. Their safety filters may reject some requests; see Acceptable Use below.
We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.
User Accounts
You must create an account to use our services. You agree to:
• Provide accurate and complete information during registration
• Maintain the security of your password and account
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account
Accounts created with email and password must verify their email address before generating content. We reserve the right to suspend or terminate accounts that violate these Terms.
Acceptable Use
You agree not to use ModelPhotoAI to:
• Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Create deepfakes, non-consensual intimate imagery, or content intended to deceive or defraud
• Upload images that you do not have the right to use, including photos of a real person's face without that person's consent
• Infringe on the intellectual property rights of others
• Attempt to reverse-engineer, decompile, or extract our AI models or algorithms
• Use automated systems (bots, scrapers) to access the service without our written consent
• Resell or redistribute access to the service without authorization
Content safety limits: our AI providers' safety filters reject some categories, including swimwear, lingerie and nudity. Those generations fail and are not charged: the credits are returned to your balance automatically.
We reserve the right to remove content and suspend accounts that violate this policy.
AI-Generated Content & Intellectual Property
You retain ownership of all images you upload to ModelPhotoAI. For AI-generated outputs:
• You are granted a perpetual, non-exclusive license to use AI-generated images for commercial and personal purposes
• We do not claim ownership of AI-generated outputs created from your inputs
• You must own or have permission to use the products, garments and reference photos you upload, and have the consent of any real person whose face you upload as a reference
• You are responsible for ensuring your use of generated content complies with applicable laws
• AI-generated content may not be perfectly accurate and should be reviewed before use in commercial contexts
ModelPhotoAI retains all rights to its platform, technology, AI models, and algorithms.
Credits
ModelPhotoAI operates on a credit-based system. Credits are used to generate AI content. New accounts receive 100 free credits on signup, with no credit card.
• Paid plans are purchased by email from the pricing page (see Paid Plans and Payment Processing)
• Credits are non-transferable between accounts
• The credits in your balance stay there until you use them
• If a generation fails or is rejected by a provider's safety filter, its credits are returned to your balance automatically (see our Refund Policy)
• Billing questions and refund requests are handled by email (see our Refund Policy)
Who to contact: failed or blocked generations, credits and account issues are handled by ModelPhotoAI support at hello@modelphotoai.com. Payments, invoices, cancellations and money refunds are also handled by email, as described in our Refund Policy.
Disclaimers
ModelPhotoAI is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding:
• The accuracy, quality, or suitability of AI-generated content
• Uninterrupted or error-free operation of the service
• The results that may be obtained from the use of the service
• The security of data transmitted through the service
AI-generated images are produced algorithmically and may contain imperfections, artifacts, or inaccuracies.
Limitation of Liability
ModelPhotoAI is liable to you in accordance with applicable Argentine law, including Consumer Protection Law No. 24,240 and the Argentine Civil and Commercial Code.
To the extent the law allows, ModelPhotoAI is not liable for damage that results from publishing or otherwise using a generated image or video without reviewing it first (see the Disclaimers section).
Nothing in these Terms limits or excludes the rights you have as a consumer under mandatory Argentine law.
Termination
You may terminate your account at any time by emailing hello@modelphotoai.com from the email address on your account. We may terminate or suspend your account immediately, without prior notice, if you breach these Terms.
Upon termination:
• Your right to access the service will cease immediately
• Any unused credits will be forfeited
• We will delete your data in accordance with our Privacy Policy
• Sections that by their nature should survive termination will remain in effect
Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Argentine Republic.
Any dispute arising from these Terms or your use of the service will first be addressed through good-faith negotiation. If it cannot be resolved that way, it will be submitted to the competent courts of the Argentine Republic, without prejudice to any jurisdiction that mandatory consumer protection rules grant you.
