ModelPhotoAI ("we", "us", "our") operates the modelphotoai.com website. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website and use our services.
By using ModelPhotoAI, you agree to the collection and use of information in accordance with this policy. If you do not agree with the terms of this Privacy Policy, please do not access the site or use our services.
Who Is Responsible for Your Data
The party responsible for your personal data (data controller) is ModelPhotoAI. ModelPhotoAI is a company based in Argentina. The service is offered only in Argentina.

Your personal data is processed in accordance with the Argentine Personal Data Protection Law No. 25,326 and its regulations.
Data We Collect
We collect information that you provide directly to us, as well as information collected automatically when you use our services.
Information You Provide
Account Information: If you sign up with email, we collect your name, email address and password (stored only as a hash). If you sign in with Google, we receive your name, email address and profile picture from Google.
Uploaded Content: Images and videos you upload (product and garment photos, reference photos, reference videos) and the text prompts you write. They are used only to generate the images and videos you request, and are stored in your account until you delete them or your account.
Generated Content: The images and videos produced for you, stored in your account gallery.
Payment Information: When you buy a plan we keep the purchase record (plan, amount, date and the email exchange). Card or bank details are entered with the payment provider indicated in our reply, not on ModelPhotoAI, and we do not store full card numbers.
Communications: Messages you send to our support email or through the contact form on our website, and messages you write to the in-app AI assistant.
Information Collected Automatically
Usage Data: Generation history (tool, status, time) and credit transactions.
Log Data: IP address, browser type, access times and requested URLs, as recorded by our hosting provider for security and troubleshooting.
How We Use Your Data
We use the information we collect to:
• Provide our image and video generation services and deliver the results to you
• Manage your account and credits, including automatic credit refunds for failed generations
• Send you service-related emails such as email verification and password resets
• Respond to your questions and support requests
• Detect, prevent, and address technical issues, fraud, and abuse
• Comply with legal obligations
ModelPhotoAI does not train AI models on your uploads or generated content. The Model Creator tool generates reference images of a persona; it does not train a model.
Payment Processing
Paid plans are purchased by email. After you request a plan from the pricing page (you must be logged in), we reply with the payment instructions, and the plan's credits are added to your account once the payment is confirmed. The Free plan (100 credits on signup, no credit card) needs no payment.
The payment provider used for your purchase is indicated in our reply. That provider processes the payment data you give it under its own terms and privacy policy; we receive the confirmation of the payment (amount, date, payer name and email).
Service Providers We Share Data With
We do not sell your personal information. To run the service we send data to the following providers (processors). Each one receives only what it needs for the purpose listed, and handles that data under its own terms and privacy policy.

Other Disclosures and International Transfers
• Legal Requirements: We may disclose your information if required by law, regulation, or legal process.
• International Transfers: Several of the providers above process data outside Argentina, including in the United States and, for the in-app AI assistant (DeepSeek), in China. Do not share sensitive personal information in assistant chats.
Your Rights
Under the Argentine Personal Data Protection Law No. 25,326 you have the following rights over your personal data:
• Right of Access: You can request information about the personal data we hold about you. Under the law, access is free of charge when requested at intervals of no less than six months, unless you show a legitimate interest in asking sooner.
• Right to Rectification and Update: You can ask us to correct or update inaccurate or incomplete data.
• Right to Deletion: You can ask us to delete your personal data, except where we must keep it to comply with a legal obligation.
To exercise any of these rights, write to hello@modelphotoai.com from the email address on your account. We will answer within the time limits set by Law 25,326.
The AGENCY FOR ACCESS TO PUBLIC INFORMATION (Agencia de Acceso a la Información Pública, AAIP), as the supervisory authority of Law No. 25,326, has the power to handle complaints and claims filed by anyone whose rights are affected by a breach of the rules on personal data protection.
Marketing Emails
We do not currently send marketing emails. We will only send them if you opt in, and every marketing email will include a way to unsubscribe. You can also contact us at hello@modelphotoai.com.
Service-related communications (such as email verification and password resets) are not marketing and are sent while you maintain an active account.
Cookies
We only use essential cookies, required for the website to function: authentication and session management. We do not use analytics or advertising cookies.
You can control cookies through your browser settings. Disabling essential cookies will prevent you from signing in.
Data Retention and Deletion
We retain your personal data for as long as your account is active or as needed to provide you services. Uploaded and generated content stays in your account until you delete it or your account.
To delete your account and its data, email hello@modelphotoai.com from the email address on your account. We complete the deletion within the time limits set by Law 25,326, except for records we must keep for legal, tax or compliance purposes.
Security
We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the Internet or method of electronic storage is 100% secure.
Children's Privacy
Our services are not intended for individuals under the age of 18. We do not knowingly collect personal data from children. If we become aware that we have collected data from a child under 18, we will take steps to delete that information.
Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Last updated" date. Continued use of the service after changes constitutes acceptance of the updated policy.
